Normally fines cannot be assessed against a person unless a proceeding has be brought to prove a violation of law.

Under the US Constitution we have a prohibition against Ex Post Facto laws, which means the state cannot create a crime for acts which have already been committed before the passage of the law. This law 'smacks' of an Ex Post Facto law.

Not only that, but it also sounds like a Bill of Attainder, which the US Constitution also prohibits. A bill of Attainder is the passage of a law that punishes a single person or identified group without a trial. The clause prohibits all legislative acts, “no matter what their form, that apply either to named individuals or to easily ascertainable members of a group in such a way as to inflict punishment on them without a judicial trial."

This NY Legislature and it governor need to take a few courses on the US constitution. By the way, these types of abuses are why we broke away from England. We are seeing that one doesn't have to be the King of England to target one's political opponents.

The more states that do it leave more energy products for the rest of us. No right minded company will do business in a state like New York.
